  RECOMMENDATION: That Council provide direction to Administration regarding the funding request associated with the BC Major Midget Hockey League – Showcase 2018 opportunity.

F.2 Report: 1769 Norwood Street – Remedial Action

  RECOMMENDATION: Remedial Action:

1. That Council under the authority provided in Section 73 of the Community Charter and after viewing the photographs of the property provided in the staff PowerPoint presentation, declares that the structure located on the property at 1769 Norwood Street, having a legal description of: Lot 9-10 Block 284 District Lot 343 Plan 1268 (Parcel Identifier: 008-803-889) is in an unsafe condition that requires remedial action to repair or demolish and remove the damaged structure,  and level the site, in order to eliminate the unsafe condition. 

2. AND FURTHER that Council, pursuant to the authority provided in Section 74 of the Community Charter and after viewing the photographs of the property provided in the staff PowerPoint presentation, declares that the structure and yard located on the property at 1769 Norwood Street, having a legal description of: Lot 9-10 Block 284 District Lot 343 Plan 1268 (Parcel Identifier: 008-803-889) is so dilapidated as to be offensive to the community and, as a result, is a declared nuisance that requires remedial action to clean up the property, repair or demolish and remove the damaged structure, and level the site, in order to eliminate the nuisance.

3. AND FURTHER that Council imposes the following remedial action requirements on Fred Umstatter, Loading Dock Supervisor, as the registered owner of the property at 1769 Norwood Street, having a legal description of: Lot 9-10 Block 284 District Lot 343 Plan 1268 (Parcel Identifier: 008-803-889) with respect to the structure and property noted above in Recommendations 1 and 2:

  • to repair the front and rear steps and decks, cinder block foundation, and roof, repaint the building, cut and remove all long grass and overgrown vegetation, or
  • to demolish the damaged structure;
  • to remove all debris from the demolition to an appropriate disposal site; and
  • level the site;

in order to eliminate the unsafe condition and declared nuisance.

Compliance and Reconsideration Notice Time Limit Recommendations:

4. AND FURTHER that Council, pursuant to Section 76 of the Community Charter, sets the time limit for completion of all the remedial action requirements described in Recommendation 3, to be no later than 5:00 p.m. on September 10, 2017.

5. AND FURTHER that Council, pursuant to Section 78 of the Community Charter, sets the time limit for giving notice of a request for Council to reconsider the remedial action requirements described in Recommendation 3, to be no later than 5:00 p.m. on July 28, 2017.

Municipal Action at Defaulter’s Expense:

6. AND FURTHER that Council authorizes Administration to take all appropriate action in accordance with Section 17 [Municipal Action at Defaulter’s Expense] of the Community Charter to ensure the subject property is brought into compliance with all the remedial action requirements described in Recommendation 3., provided that:

a. the property owner has not fully completed the remedial action requirements on or before the time limit specified in this Council resolution; and

b. all costs incurred by the City to bring the property into compliance shall be at the expense of the property owner and, pursuant to Section 17 of the Community Charter, such costs shall be recovered from the property owner as a debt owed to the City of Prince George.

2. That Council CONSIDER “City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 8860, 2017”, in conjunction with the current Financial Plan and confirm there are no issues.

3. That Council CONSIDER “City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 8860, 2017”, in conjunction with the current Regional District of Fraser Fort-George Solid Waste Management Plan and confirm there are no issues.

4. That Council CONSIDER “City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 8860, 2017”, in conjunction with the City of Prince George Strategic Framework for a Sustainable Prince George and confirm there are no issues.

  RECOMMENDATION: That Council DENY FIRST AND SECOND READINGS of "City of Prince George Zoning Bylaw No. 7850, 2007, Amendment Bylaw No. 8861, 2017" to rezone the Lot 1, District Lot 753, Cariboo District, Plan BCP41482 from C2: Regional Commercial to RM6: Mid-Rise Residential, as shown on Appendix “A” to Bylaw No. 8861, 2017.
  ALTERNATE RECOMMENDATION:

1. That Council GIVE FIRST and SECOND READINGS to “City of Prince George Zoning Bylaw No. 7850, 2007, Amendment Bylaw No. 8861, 2017” to rezone Lot 1, District Lot 753, Cariboo District, Plan BCP41482 from C2: Regional Commercial to RM6: Mid-Rise Residential, as shown on Appendix “A” to Bylaw No. 8861, 2017.

2. That the Public Hearing of Bylaw No, 8860, 2017 and Bylaw No. 8861, 2017 BE WITHHELD until the following requirements have been met to the satisfaction of Administration:

    1. Development Permit Submission;
    2. Receipt of a Traffic Impact Study.

3. That Final Reading of proposed Bylaw No. 8860, 2017 and Bylaw No. 8861, 2017 BE WITHHELD until the following requirements have been met to the satisfaction of Administration:

    1. Receipt of a Servicing Brief;
    2. Development Permit approval;
    3. Registration of a Covenant restricting the design of the development to the design approved through the Development Permit Process;
In addition, any recommendations presented in the preceding items must be addressed to the satisfaction of the General Manager of Planning and Development.
