REGULAR COUNCIL MEETING AGENDA

That the minutes of the regular Council meeting held August 19, 2019, BE ADOPTED as read on this day and that such minutes as read set out all of the business before Council at that meeting and fully and properly record all of the resolutions and bylaws passed and adopted by Council at that meeting.

THAT Council APPROVE Variance Permit No. VP100548 to vary City of Prince George Zoning Bylaw No. 7850, 2007 for the property legally described as Lot 5, District Lot 4048, Cariboo District, Plan PGP40498 as follows:

1. Vary Section 10.2.5 6. by decreasing the minimum interior side yard setback from 1.2 m to 0.45 m, as shown on Exhibit "A" to VP100548.

THAT Council APPROVE Development Variance Permit No. VP100540 to vary City of Prince George Zoning Bylaw No. 7850, 2007 for the property legally described as Lot 9, Block 77, District Lot 343, Cariboo District, Plan 1268 as follows:

1. Vary Section 10.4.6 6. to reduce the minimum exterior side yard of the principal development from 3.0 m to 2.1 m, as shown on Exhibit "A" to VP100540.

Be it resolved that:

1. Council supports the issuance of the license to increase the occupant load for the following reasons:
   
   This application is not expected to have negative impact on the community or produce any significant land use impacts on adjacent properties.
   
   
2. Council's comments on the prescribed considerations are as set out in the August 23, 2019 staff report from Ian Wells, General Manager of Planning and Development for Liquor Licence Application No. LL100162.
   
   
3. The methods used to gather the views of residents are as follows:
   
   The views of residents were collected in a Public Hearing held on September 9, 2019 in Council Chambers. The public notice for this hearing included 1) a sign was posted on the property ten (10) days prior to the hearing, 2) written notification to owners and tenants in occupation of all parcels within the area that was the subject of the application, and within a distance 30 metres from the land that was subject of this application ten (10) days prior to the hearing, and 3) advertisements were placed in two (2) consecutive issues of a newspaper, not less than three (3) and not more than ten (10) days before the hearing.
   
   The views of residents are as summarized in the minutes of the Public Hearing held on September 9, 2019

That Council AMEND the 2019 Council Meeting Calendar to re-schedule the Monday, October 21, 2019 Council Meeting to Wednesday, October 23, 2019.

THAT Council APPROVE the 2020 Council Meeting Calendar as attached to the report dated August 20, 2019 from the General Manager of Administrative Services titled "2020 Council Meeting Schedule".

That Council APPROVE the proposed Snow and Ice Control Council Policy as attached to the report dated August 28, 2019 from the General Manager of Engineering and Public Works.

THAT Council:

1. GIVE First Reading to "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9063, 2019."
2. CONSIDER "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9063, 2019", in conjunction with the current Financial Plan and confirm there are no issues.
3. CONSIDER "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9063, 2019", in conjunction with the current Regional District of Fraser Fort-George Solid Waste Management Plan and confirm there are no issues.
4. CONSIDER "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9063, 2019", in conjunction with the City of Prince George Strategic Framework for a Sustainable Prince George and confirm there are no issues.
5. GIVE Second Reading to "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9063, 2019."
6. APPROVE the following public consultation process to fulfill the requirements of Section 475 of the Local Government Act:
   1. Two (2) Citywide Newspaper advertisements requesting written comment;
   2. Request for written comment from properties identified on Exhibit "A" to CP100155; and
   3. One (1) Public Meeting.
7. GIVE First and Second Reading to "City of Prince George Zoning Bylaw No. 7850, 2007, Amendment Bylaw No. 9064, 2019."
8. PERMIT the Public Hearing for proposed Bylaw No. 9063 and Bylaw No. 9064 BE WITHHELD until the following requirements have been met to the satisfaction of Administration:
   1. Receipt of a Parking and Landscaping Plan.
9. PERMIT that consideration of Final Reading of proposed Bylaw No. 9063 and Bylaw No. 9064 BE WITHHELD until the following requirements have been met to the satisfaction of Administration:
   1. Receipt of security in the amount of 120% of the cost of the landscaping and paving works identified on the Parking and Landscaping Plan.
   2. Receipt of confirmation that the following lots have been consolidated:
      • Lot A (54552M), Block 329, District Lot 343, Cariboo District, Plan 1268;
      • Lots 3 and 4, Block 329, District Lot 343, Cariboo District, Plan 1268;
      • Lot 8, District Lot 343, Cariboo District, Plan 18815;
      • Lots 17, 18, 19 and 20, Block 329, District Lot 343, Cariboo District, Plan 1268; and
      • Parcel 1, District Lot 343, Cariboo District, Plan BCP24383.
   3. Registration of a Section 219 Covenant on the legal titles that restricts the use of the subject area to "vehicle sale, minor" only.

In addition, any recommendations presented in the preceding items must be addressed to the satisfaction of the General Manager of Planning and Development.

THAT Council:

1. GIVE First Reading to "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9070, 2019."
2. CONSIDER "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9070, 2019", in conjunction with the current Financial Plan and confirm there are no issues.
3. CONSIDER "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9070, 2019", in conjunction with the current Regional District of Fraser Fort-George Solid Waste Management Plan and confirm there are no issues.
4. CONSIDER "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9070, 2019", in conjunction with the City of Prince George Strategic Framework for a Sustainable Prince George and confirm there are no issues.
5. GIVE Second Reading to "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9070, 2019".
6. APPROVE the following public consultation process to fulfill the requirements of Section 475 of the Local Government Act:
   1. One (1) Citywide Newspaper advertisement requesting written comment.
7. RECEIVE North Nechako Neighbourhood Plan for information.

THAT Council:

1. DENY First and Second Reading to "City of Prince George Official Community Plan Bylaw No. 8383, 2011, Amendment Bylaw No. 9022, 2019."
2. DENY First and Second Reading to "City of Prince George Zoning Bylaw No. 7850, 2007, Amendment Bylaw No. 9023, 2019."
3. Should Council approve "City of Prince George Official Community Plan Bylaw No. 8383, 2011 Amendment Bylaw No. 9022, 2019" and "City of Prince George Zoning Bylaw No. 7850, 2007 Amendment Bylaw No. 9023, 2019" the recommendations itemized in the "Alternatives" Section of this report BE APPLIED.
    

THAT Council instruct the Corporate Officer to advise Innovation, Science and Economic Development Canada in writing that:

1. TELUS has satisfactorily completed its consultation with the City of Prince George;
2. The City of Prince George is satisfied with TELUS' public consultation process and does not require any further consultation with the public; and,
3. The City of Prince George concurs with TELUS' proposal to construct a wireless communications facility provided it is constructed substantially in accordance with the plans submitted to the City of Prince George for a 60.0 metre self-support tower with 15 antennas and 4.0 metre lightning rod mounted at the top of the structure on the subject property (NW ¼ of District Lot District Lot 2432 Cariboo District, except plan PGP39486).

That Council RECEIVE FOR INFORMATION the report dated August 28, 2019 from the Director of External Relations on the activities and schedule planned for Talktober 2019.

That Council GRANT FINAL READING AND ADOPTION to "City of Prince George Zoning Bylaw No. 7850, 2007, Amendment Bylaw No. 9042, 2019."
